Cancellations: Cancellations must be made in writing. If the client cancels within 30 days of the event, the client remains responsible for 50% of the contracted fee. Cancellations within 7 days require full payment. 3. Payments, Deposits, and Refunds Deposits: A non-refundable retainer/deposit of 50% is required at the time of contract execution to secure the performance date. Final Payment: The remaining balance is due no later than the date of the performance, prior to the start of the show, unless alternative Net-30 arrangements have been formally approved. Non-Sufficient Funds (NSF) Fee In the event that a check provided to Assassin Entertainment LLC for a deposit, final performance balance, or any other service is returned by the bank unpaid due to non-sufficient funds, a closed account, or a stop-payment order, a $50.00 Recovery Fee will be automatically assessed to the client’s account. 2. Justification of Fee This $50.00 fee is designed to cover the administrative labor required to resolve the payment issue, as well as the bank penalties and processing charges incurred by Assassin Entertainment LLC as a result of the returned item. 3. Resolution Timeline & Payment Method Upon notification of a bounced check, the client must resolve the outstanding balance, including the $50.00 recovery fee, within 48 hours. To ensure immediate clearance, the replacement payment must be made via a guaranteed fund method, such as a credit card (via Wix Studio portal), cashier’s check, or cash. Personal or business checks will not be accepted as a replacement for a previously bounced check. 4. Impact on Performance & Deliverables Pre-Show: If a deposit check bounces, the performance date is not considered "secured" and may be released to other clients until the balance and fees are paid in full. Post-Show: If a final payment check bounces, all media deliverables (such as recordings for the The Name Behind the Pixels podcast or show sizzle reels) and "The Killer Awards" performance credits will be withheld until the account is settled. 5. Legal & Collection Action Assassin Entertainment LLC reserves the right to pursue all legal remedies available under New Mexico state law for the collection of dishonored checks, which may include reporting to credit bureaus or filing a claim in the small claims court of Rio Rancho/Sandoval County. 1. BOOKING AND DEPOSIT Quote Validity: This agreement and any quoted pricing are valid for thirty (30) calendar days from the date of the quote. Securing Your Date: The event date is not secured until both the signed agreement and the required deposit are received. Dates are booked on a strictly first-come, first-served basis. Deposit Amount: A non-refundable deposit of twenty percent (20%) of the total price or a minimum of two hundred dollars ($200), whichever is greater, is required to secure the date. Rebooking: If a mutually agreeable new date is set within 365 days of the original date, a $250 rebooking fee will be applied. Previous payments (minus the fee) will be applied to the new agreement at current pricing. 5. PUBLIC CONDUCT AND NON-DISPARAGEMENT Neutrality: In the event of a cancellation due to payment failure, both parties agree to limit public announcements to a neutral statement (e.g., "The event is canceled and parties are seeking a future date"). Non-Disparagement: The Client agrees not to publish or encourage disparaging or defamatory comments regarding Assassin Entertainment LLC or its owners on any platform. Violation of this provision may result in legal action. 6. LIABILITY AND INDEMNIFICATION Equipment Safety: Performance requires power and signal cables that may present tripping hazards. Guests should avoid these areas. Assassin Entertainment LLC is not liable for injuries relating to cables, props, or equipment. Indemnification: The Client agrees to indemnify and hold harmless Assassin Entertainment LLC from all claims or damages arising from the event, including physical injury or emotional distress arising from participation in hypnosis or comedy, except in cases of gross negligence. Damaged Equipment: The Client is responsible for any damage to equipment caused by guests (e.g., spills, theft, or knocking over gear). Normal wear and tear is excluded. 7. EVENT REQUIREMENTS Access: Access to the venue is required at least one hour before guest arrival or show start time, whichever is earlier. Electrical: We require access to at least two (2) standard 120V AC outlets (15 amp load) within 50 feet of the performance area. Lighting Warning: Unless requested otherwise 30 days in advance, party lasers and strobe-like effects may be used. The Client is responsible for informing guests who may be susceptible to epileptic side effects. Safe Environment: The Client must provide a safe working environment. We reserve the right to cease performance without refund if the environment becomes unsafe due to aggressive, intoxicated, or inappropriate behavior. 8. MEDIA RIGHTS Likeness: Assassin Entertainment LLC reserves the right to use any media collected during the event (or that we are tagged in) for future promotions. Recorded Shows: We may record the performance and offer it for purchase. The Client warrants they have secured necessary permissions from attendees for their likeness to be used. 9. OUTDOOR EVENTS AND FORCE MAJEURE Weather: For outdoor shows, temperatures must be between 60° and 100°F with no precipitation. If weather prevents the show and no indoor backup is available, the full balance remains due. Force Majeure: Neither party is liable for delays caused by "Acts of God," severe illness, or natural disasters. We will make every effort to reschedule in these instances. 10. DISPUTE RESOLUTION Process: Initial disputes must be submitted in writing to Office@AssassinEntertainment.com.
